Please read these Terms and Conditions carefully before using the LodgeStatus platform. These terms constitute a legally binding agreement between you and LodgeStatus.
1. Acceptance of Terms
By accessing or using LodgeStatus ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, do not use the Service. These terms apply to all users, including browsers, vendors, customers, merchants, and contributors of content.
2. Description of Service
LodgeStatus provides a cloud-based hotel management platform including property management, booking management, guest communication, financial reporting, and related services. The Service is provided on a subscription basis and may be accessed via web browser or approved mobile applications.
3. Account Registration
To access the Service, you must register for an account. You agree to provide accurate, current, and complete information and to update this information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use.
4. Subscription & Billing
LodgeStatus is offered on monthly or annual subscription plans. By providing payment information, you authorize us to charge the applicable subscription fee. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of the Service.
5. Acceptable Use
You may not use the Service for any unlawful purpose or to violate any regulations. You agree not to reverse engineer, decompile, or disassemble the Service; introduce malicious code; attempt unauthorized access; or use the Service to store or transmit infringing, defamatory, or unlawful content. We reserve the right to terminate accounts violating these terms.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by LodgeStatus and are protected by international copyright, trademark, patent, and other intellectual property laws. Your data remains your property. By using the Service, you grant LodgeStatus a limited, non-exclusive license to store, process, and display your data solely to provide the Service.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that your use of guest data complies with applicable data protection laws, including GDPR where applicable.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. LodgeStatus does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.
9. Limitation of Liability
To the maximum extent permitted by law, LodgeStatus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes. Your continued use of the Service after the effective date of the revised terms constitutes your acceptance of the changes.
